Also in 1975, Benjamin v. Malcolm was filed on behalf of pre-trial detainees in the New York City House of Detention for Men on Rikers Island challenging overcrowding and unsanitary and inhumane conditions. In Herring v. New York, the U.S. Supreme Court held unconstitutional a New York statute authorizing a Judge, in a non-jury trial, to deny a defendant the right to summation.
