Statement from The Legal Aid Society on Misinformation About Public Charge Immigration Rules

The Rules Have Not Changed for People In the U.S.

The Legal Aid Society released the following statement today following recent news reports with incorrect information about proposed new rules for individuals receiving public benefits:

“The rules for public charge have NOT changed.

  • People with Lawful Permanent Resident (LPR or ‘green card’) status are not facing a new risk of deportation or removal if they use public benefits.  

  • There is a proposal to change the rules, but it is just a proposal; and the soonest the rules could change would be March, 2019. The proposed rules mostly affect people who are applying to get their green card through a family member, not people who already have their green card.
